Bail & Bail Bondsmen – How To Get Out of Jail

Naturally, once you’re in jail, your only thought is when and how to get out. After you’ve gone through the intake process, bail will be set either by bail schedule or magistrate. In cases where no bail is set this may mean that you will either be free to go until your trial, or you don’t get released while you wait for your court date.

If you do bail out you will have to promise to be in court on your court date, and until then you can’t leave the area.

In most cases, a prisoner at Murray County Jail can earn time off for good behavior if they follow the rules and conduct themselves properly while they are in jail.

If you prove to be trustworthy, you may be allowed to participate in a work release program. Either you will have to stay the jail every day when you’re finished working, or you could be permitted to sleep in a halfway house when you are not working.

Bail

Bail is the amount of money that you are required to pay to get out of jail until you go to court. The amount you will have to pay depends on the crime you’ve been charged with. You will have to post ten percent of the total that was determined so you can get out of jail. If you don’t go to your scheduled court date, whoever paid your bail won’t get the bail money back.

Find Out How Much Someone’s Bail Is

To find out how much bail money you will need to bail someone out of jail need to call the jail. If you have all the person’s information, like name, address and date of birth, they’ll be able to let you know what their bail is set at. You can also check their bail amount and status online.

How To Bail Someone Out of Jail

Needing to bail someone out of jail is an unpleasant situation, but in some cases, its simple to do if you have the money. First of all, you have to find out if their bail is a “Cash Bond Only”. If this is the case, you won’t be able to use the services of a Bail Bondsman. Take cash only to the jail – the jail can’t accept checks. As soon as you’ve paid the bail bond, the prisoner will be released to your care. If this person doesn’t violate any of the terms of their release, you’ll get the bail money back.

Bail Bondsman

If the amount of bail set is large, or you just can’t afford to pay it, you should use a bail bondsman. Bail bondsmen will generally have a fee of 10 to 15 percent of the total bail amount, and in most cases charge a minimum fee of $100. This money is non-refundable and the bondsman only accepts cash. If their bail has been set particularly high, the bondsman might request to use your assets, such as home, property or cars, as collateral in addition to the fee they charge.

Jail Policies and Procedures

Intake Procedures / Booking

The intake procedure is made up of each of the following steps:

  • You will be placed in a waiting area or cell. If the jail is really busy, you may not be processed immediately.
  • The first step is that you will have to answer some simple questions, such as what your legal name is, your address, date of birth and a contact person.
  • You will also be asked about your medical and psychological history.
  • You’ll be given an inmate ID number.
  • You will be fingerprinted.
  • You will have your mugshot taken.
  • All personal property will be taken away from you and stored until you are discharged.
  • They will allow you to make a phone call to call a family member, friend, or bail bondsman.
  • If you think you will get released quickly, you might be allowed to keep wearing your own clothes, if not you will have to change into a jail issued jumpsuit.

Have you ever been booked into jail? If you have, please tell our readers about your experience. How long did it take to get processed? Were you treated fairly? Do you have any things that might help other people that get arrested get through jail intake?

Speak Your Mind

Discharge Procedures

When you pay your bail, you will get discharged from jail. Getting discharged from jail will take anywhere from 10 minutes to all day. So, the quicker you post bail, the faster you will get discharged. Also, how fast you get released will depend on whether or not you have a cash bond or if the judge has to decide on your bail amount. For a minor offense, you will simply be booked and released on your own recognizance. If you have served a sentence in jail and have a discharge date, you should plan to get discharged at any time that day – but usually in the morning.

How To Turn Yourself In

If there is a, or if you must start a jail sentence, you really should follow the rules and turn yourself in. For a warrant, go down to the jail intake area, and tell them that think that there is an outstanding warrant for your arrest. The officer will verify that you have an outstanding arrest warrant, and if so, you will be taken into custody. If you are reporting to serve out your sentence, report to the jail at the exact time and date that the sentence order lists. Be sure that you are not late. Be sure to only bring required items with you, such as your driver’s license or even state issued ID, prescription medication, as well as the copy of the sentencing order.

Visitation Procedures

The inmate need to give the name and date of birth of each visitor to the jail in advance of any visit. Your visitor’s information will be put into the visitation log for the requesting inmate. Each and every visitor must provide identification. Anyone that gets to visitation or any visitors that are not approved to visit will not be able to attend visitation.
Jail visitation policies change often, so visit the official jail site before you go to visitation.

Visiting Hours

Phone Calls & Phone Usage Policy

The only phone calls that inmates are allowed to make are with a pre-paid phone card or account, or are collect calls . Calls made in jail are much more expensive than phone calls made outside of jail. There is no limit to when and how often you can use the phone, but bear in mind lots of people want to use the phone – so you have to share. If you break the rules and are disciplined, an inmate’s phone privileges could be reduced or forbidden completely.

Court Information

Get A Lawyer

When you get arrested, you should know you still have rights, the first of which is the right to request a lawyer. You are only allowed to make so many phone calls in jail, so you would be wise to get a friend or family member to find an attorney when you talk to them. You might be asking yourself ‘do I really need a lawyer?’ You are not required to have an attorney for some criminal charges, a lawyer will make sure you know your rights, help protect your interests and guide you through the legal system that you are now faced with. The faster you get a lawyer involved with your case, the better your chances.

For more info on the benefits of hiring a lawyer, go to: How to Find an Attorney in Murray County

Public Defender

If you’ve been arrested and don’t have the money to hire an attorney, you will get a public defender. The Public Defender is staffed by independent investigators, forensics experts and social case workers. You will be reassured to know that Public Defenders are licensed lawyers that are members of the Georgia State Bar and are fully licensed to practice law in Georgia.

Have you or someone you know used a court appointed attorney? What was your experience?

Court Records

All court records are public record and are available upon request to anyone who requests them – not just the person who they pertain to. Court records have a case file with a docket and each of the documents that have been filed in the case. You are able to access the records and documents in your court case using the internet service, or by going to the Murray County Clerk of Court.

Clerk of Court

The Murray County Clerk of Court is an officer and clerk of the court who maintains court records and controls access to them. They also administer the oath for any court participant who must be under oath, and read the jury’s verdict. All court records related to your case are kept at Clerk of Court’s office.

Fees

Court costs and court fees are the charges associated with your court case, which include filing fees, motion and claim fees, and court charges. If you don’t have the money to pay these fees and have a court appointed attorney, you can get a waiver for these fees.

Magistrate

The magistrate acts as the judge that rules over your court case. Magistrates do a number of things, such as setting bail, issuing warrants, and presiding over preliminary court hearings and detention proceedings.

Pre-Sentencing

A pre-sentencing report is prepared to include information about the defendant’s background and as much detail about the defendant’s life, which the judge will take into account when determining your sentence. Information will be gathered from the person on trial, his or her family, and, if applicable, the victim in the crime. Don’t forget you can ask to get a copy of the report before you are sentenced, and review it for accuracy and completeness, and correct any mistakes.

Sentencing

When you are convicted of a crime, you will then get sentenced. The presiding judge in your case will weigh several options when determining your sentence, ranging from community service to probation, to incarceration in jail or prison. Depending on how serious your crime was, you could be taken into custody, right there in court, or you might be given a date that you must turn yourself into jail to do your time.

Life In Jail / What Its Like

    Daily Life

Just the thought of spending time in Murray County Jail is no fun, you will soon get accustomed to the routine that is set for you. Prisoners get an alarm for wake-up at about 6:00 AM, and next they’ll do roll call. Then you will have breakfast. When you finish eating breakfast participate in the work program or other activity that you are assigned. This could be working in the kitchen, laundry, or some sort of manufacturing job. While this may seem tedious, it may help you when you leave jail, as you are gaining experience in a certain field of work. Other inmates go to school, while some take part in mandated treatment programs. After lunch, there will be another roll call, then back to work. Your evening will be spent either in your cell or a common room. During this time dinner is served and you will be expected to take a shower. After another roll call, it’s lights out. Even though you will be confined to your cell, there may be enough light to read or write letters. Then again, most inmates welcome lights out, and try to get as much sleep as they can.

Most people are frightened at the idea of jail because they don’t know what to expect. If you have spent any time in Murray County Jail, your experiences would be welcomed, if it can help another person to deal with it.

    Dress Code

When incarcerated, all inmates are expected to wear the Murray County Jail uniform. This is normally a jumpsuit or scrubs. Of note to anyone visiting an inmate – you must be properly dressed. Any clothing considered inappropriate will not be permitted.

How To Send Money to an Inmate

You will have your own ‘bank account’ while in jail. This money is used to purchase items from the Commissary. Family and friends can deposit money into this account for you, and any money you earn while in prison will also be deposited into your account. Outside money can be paid in to your account via a money order, cash or check. If someone sends a check or money order, make sure that they write your inmate ID on it. The maximum amount you are allowed in your account is $290 per month.

The process for sending funds to inmates at Murray County Jail changes, so you should double check the official website before you send any money.

    Commissary

The commissary is the jail store. You can purchase a number of things here, such as toiletries, snacks and writing supplies. Bear in mind that you will probably want to use the commissary daily, and any infractions will get that privilege taken away from you.

    Inmate Medications

If you are on any type of prescription medication, you will be allowed to continue taking it while in jail. When you are first processed, you will be asked what medication you take. You will then be referred to the jail nurse or doctor who will be in charge of monitoring your health and prescribing your medication.

    Meals

You will get three meals a day: breakfast, lunch and dinner. As expected, they are very basic, but healthy. A typical breakfast might be cereal, toast, coffee and fruit. Lunch might be spaghetti, salad, bread and milk. Dinner could be chicken casserole, rice, vegetables, dessert and milk. Contrary to popular belief, prison food has greatly improved over the years, and you might find that it’s not much different from what you would eat at home.

    Pods / The Yard

The jail is designed in a ‘pod’ layout, with self-contained housing arranged around an outdoor yard. Each pod has a central control station and a common room, and the inmates take turns in using the yard. The jail is designed this way to keep certain inmates together, and others away from the general population.

    Gangs

As with life in general, gangs are a part of prison life. Obviously it is best to avoid becoming a part of this environment as it will only lead to trouble. When you first enter prison, you might find yourself being ‘primed’ to join a gang, or worse, you might get their attention in a negative way. The best thing to do is keep your head down and don’t get involved.
