Bail & Bail Bondsmen – How To Get Out of Jail

Naturally, if you are in jail, your only thought is about how to get out. After you’ve gone through booking, a bail amount is determined either through a preset bail schedule or a magistrate. If you don’t get a bail set this may mean that you will either be free to go until your trial, or you are kept in jail until your court date.

If you are released you will have to promise to be there for your court date, and until then you are not allowed to go out of town.

Usually, an inmate can earn time off in exchange for good behavior if they respect the rules and area a good inmate while incarcerated.

If you prove to be trustworthy, you might be given work release detail. You will either have to go back to jail every day when you’re finished with work, or you could get to live in a halfway house instead of the jail.

Bail

Your bail is how much money that you have to pay to the courts to get out of jail until your court date. The amount you will have to pay is determined by the crime you’ve been charged with. You will have to put up 10% of the amount that was set so you can be released. If you don’t go to your scheduled court date, whoever posted your bail will lose all of the bail money.

Find Out How Much Someone’s Bail Is

In order to find out how much someone’s bail is, you need to call the jail. If know the pertinent information, including name, address and date of birth, they’ll let you know what their bail is set at. You can also find out how much their bail is on the Steuben County Jail site.

How To Bail Someone Out of Jail

Posting bail to get out of jail is never a fun thing, but in some cases, its easy if you have the money. First of all, you have to find out if it is a “Cash Bond Only”. If it is, you can’t use a Bail Bondsman. Bail can only be paid by cash – the jail can’t accept a check. Once you have paid the bond, the prisoner will be released into your care. If this person doesn’t violate any of the terms of their release, you’ll get the bail money back.

Bail Bondsman

If their bail has been set too high, or you can’t afford it yourself, you will need to use a bail bondsman. Bondsmen usually charge you a fee of 10 to 15 percent of the total amount of bail set, and sometimes with a minimum charge of $100. The amount you pay to the bondsman will not be returned to you and bondsmen usually only accept cash. If the bail is extremely high, the bondsman will in these cases require that they use your assets as collateral for the bond.

Intake Procedures / Booking

The intake process takes you through each of the following steps:

  • You will get put in a holding cell. If there are a lot of arrests, you will have to wait a while to get processed.
  • The first step is that you will have to answer some simple questions, such as what is your full legal name, address, date of birth and contact person.
  • You will also be asked about your medical and mental history.
  • You will be issued an inmate ID.
  • You will be fingerprinted.
  • You will have your mugshot taken.
  • All personal property will be taken from you and stored until you are discharged.
  • They will let you make a telephone call so you can call a member of your family, friend, or bail bondsman.
  • If you think you will get released quickly, you might be able to skip the jumpsuit and keep wearing your own clothes, but if you are not expected to make bail quickly you will be issued a jail uniform – the jumpsuit.

Have you ever been arrested and gone through processing at jail? If you have, please share your experience. How long did it take to get through intake? What was your treatment like? Do you have any tips that might help others get through the process?

Discharge Procedures

When you post bail, you will be discharged from jail. The discharge process takes anywhere between 30 minutes to many hours. So, the faster you post bail, the faster you will get out of jail. How quickly you get discharged can depend on if you have a bond amount or if a judge must determine how much your bail will be. For minor charges, you will be booked and released on your own recognizance. When you have completed your jail sentence and have a date of your release, expect to be released in the morning.

How To Turn Yourself In

If the sheriff has a, or if you have to begin your jail sentence, you should follow the law and go down to the jail and turn yourself in. For a warrant, go to the jail, in the reception area, and tell someone that you think they might have an outstanding warrant for your arrest. They will do a check to find out if there is an arrest warrant for you, and if they find one, you will be taken into the sheriff’s custody. If you have a jail sentence to serve, go down to the jail at the time and date that the sentence order requires you to. Be sure that you are not late to report. Be sure to only bring things that are allowed when you go, such as a driver’s license or your ID, prescription medication, and a copy of the sentencing order.

Visitation Procedures

To have visitors, you must give each visitor’s full name to the jail before anyone can visit them. Your visitor’s names will be entered into the visitation log for the inmate that requested the visitor. Each visitor must provide proof of identification. Visitors arriving late or that is not an approved visitor will not be allowed to attend visitation.
The Steuben County Jail visitation procedures can change, so we suggest that you double-check the jail site before you try to go to visitation.

Visiting Hours

Phone Calls & Phone Usage Policy

The only phone calls that inmates are allowed to make are made through a jail approved pre-paid phone account or phone card . Phone calls made in jail are a lot more expensive than regular phone calls. Phone calls are restricted on how often you can use the phone, but inmates must keep in mind that every inmate wants to use the phone too, so they can call their family. If you break the jail rules, an inmate’s phone privileges might get cut back or forbidden.

The Steuben County Jail phone number is: 260-668-1000

Get A Lawyer

If you get arrested, you still have rights, the first of which is your right to request an attorney. You don’t get to make many phone calls when you get arrested, so it is important to get a friend or family member to find an attorney when you call. You might be asking yourself ‘do I really need an attorney?’ While you are not required to have one, a lawyer will make sure you know your rights, look after your best interests and help you understand the legal system in your county. The quicker you get a lawyer involved with your charges, the better.

For more detailed information on how to find an attorney, click: How to Find an Attorney

Public Defender

If you are in trouble, but can’t afford an attorney, you will be assigned a public defender. The Public Defender Office is staffed by investigators, crime scene and forensics experts as well as social case workers. Have you or someone you know used the services of a Public Defender? How did they do?

Pre-Sentencing

Your pre-sentencing report is put together with your background information and information about the defendant’s life and history, which the magistrate will review and take into consideration when determining your sentence. Information and personal details will be gathered from the defendant, the defendant’s family, and if necessary the victim in the crime. Keep in mind that you should ask to receive your own copy of your pre-sentencing report prior to sentencing, so you get the chance to review it for accuracy and completeness, and correct any mistakes.

Sentencing

If you get convicted of a crime, you will be sentenced. There are a number of different options, ranging from community service and probation, to incarceration in jail or prison. Depending on sentencing guidelines and the severity of your crime, you might get immediately taken into custody, or given a date that you are supposed to surrender and report to jail to serve out your sentence.

Life In Jail / What Its Like

    Daily Life

Everyone knows that spending time in the Steuben County jail is very scary, eventually you will get accustomed to the routine that is set for you in jail. Inmates get an alarm for wake-up at 6:00am, and then you’ll have roll call. Next, you will eat breakfast. Following breakfast participate in the program that has been assigned to you. This could be working in the kitchen, laundry, or some sort of manufacturing job. While this may seem tedious, it may help you when you leave jail, as you are gaining experience in a certain field of work. Other inmates go to school, while some take part in mandated treatment programs. After lunch, there will be another roll call, then back to work. Your evening will be spent either in your cell or a common room. During this time dinner is served and you will be expected to take a shower. After another roll call, it’s lights out. Even though you will be confined to your cell, there may be enough light to read or write letters. Then again, most inmates welcome lights out, and try to get as much sleep as they can.

Most people are frightened at the idea of jail because they don’t know what to expect. If you have spent any time in Steuben County Jail, your experiences would be welcomed, if it can help another person to deal with it.

    Dress Code

When incarcerated, all inmates are expected to wear the Steuben County Jail uniform. This is normally a jumpsuit or scrubs. Of note to anyone visiting an inmate – you must be properly dressed. Any clothing considered inappropriate will not be permitted.

How To Send Money to an Inmate

You will have your own ‘bank account’ while in jail. This money is used to purchase items from the Commissary. Family and friends can deposit money into this account for you, and any money you earn while in prison will also be deposited into your account. Outside money can be paid in to your account via a money order, cash or check. If someone sends a check or money order, make sure that they write your inmate ID on it. The maximum amount you are allowed in your account is $290 per month.

The procedure to send funds to someone in jail changes, so check the official website when you send any money.

    Commissary

The commissary is the jail store. You can purchase a number of things here, such as toiletries, snacks and writing supplies. Bear in mind that you will probably want to use the commissary daily, and any infractions will get that privilege taken away from you.

    Inmate Medications

If you are on any type of prescription medication, you will be allowed to continue taking it while in jail. When you are first processed, you will be asked what medication you take. You will then be referred to the jail nurse or doctor who will be in charge of monitoring your health and prescribing your medication.

    Meals

You will get three meals a day: breakfast, lunch and dinner. As expected, they are very basic, but healthy. A typical breakfast might be cereal, toast, coffee and fruit. Lunch might be spaghetti, salad, bread and milk. Dinner could be chicken casserole, rice, vegetables, dessert and milk. Contrary to popular belief, prison food has greatly improved over the years, and you might find that it’s not much different from what you would eat at home.

    Pods / The Yard

The jail is designed in a ‘pod’ layout, with self-contained housing arranged around an outdoor yard. Each pod has a central control station and a common room, and the inmates take turns in using the yard. The jail is designed this way to keep certain inmates together, and others away from the general population.

    Gangs

As with life in general, gangs are a part of prison life. Obviously it is best to avoid becoming a part of this environment as it will only lead to trouble. When you first enter prison, you might find yourself being ‘primed’ to join a gang, or worse, you might get their attention in a negative way. The best thing to do is keep your head down and don’t get involved.
